The Fairfax County Board of Supervisors unanimously voted Tuesday to move forward with a 3.5% local tax on recreational marijuana sales, the highest rate permitted by Virginia law, FOX 5 DC reports.

Localities must set a rate by ordinance between 1% and 3.5%. The local tax is in addition to the state marijuana tax (starting at 6% until July 1, 2029, then 8%) and standard sales taxes.

A draft ordinance is expected in spring 2027, followed by a public hearing. Retail cannabis sales statewide are set to begin July 1, 2027.
